Präsidenten im Nuklearbereich wurde von Markey und dem Kongressabgeordneten Ted Lew (Demokrat aus Kalifornien) ausgearbeitet.

Sie schlagen vor, «jedem US-Präsidenten zu verbieten, ohne vorherige Zustimmung des Kongresses einen Atomschlag zu führen».

«Kein Präsident hat das Recht oder die verfassungsmäßige Befugnis, einseitig den Krieg zu erklären, geschweige denn einen Atomschlag zu starten», zitiert die Pressestelle Markey.

«Der Präsident hat die ausschließliche Befugnis, den Einsatz von Atomwaffen zu genehmigen, ein Befehl, den das US-Militär nach dem Uniform Code of Military Procedure befolgen muss. In Anbetracht der verfassungsmäßigen Befugnis des Kongresses, den Krieg zu erklären, muss er die alleinige Befugnis des Präsidenten, den Einsatz von Atomwaffen zu genehmigen, wirksam kontrollieren», heißt es in dem Gesetzentwurf.

«Die Schöpfer der Verfassung waren sich darüber im Klaren, dass die Entscheidung, in einen Krieg zu ziehen, der viele Tote und die Zerstörung der zivilisierten Gesellschaft zur Folge haben könnte, von Vertretern des Volkes getroffen werden muss, nicht von einer einzelnen Person. Atomwaffen sind eine außerordentlich mächtige Waffenart, die Millionen von Menschen sofort töten und langfristige negative Auswirkungen auf die Gesundheit und die Umwelt in der ganzen Welt haben kann, sie untergraben den Weltfrieden auf direkteste Weise und setzen die USA dem Risiko eines nuklearen Vergeltungsschlags aus», heißt es in dem Dokument.

Markey und Lew hatten bereits 2016 einen ähnlichen Gesetzentwurf in den Kongress eingebracht, der jedoch nicht angenommen wurde.
